How affidavits and sworn statements are notarized
An affidavit or sworn statement is notarized using a jurat. With a jurat, you appear before the notary, swear or affirm that the contents of the statement are true, and sign the document in the notary’s presence. The notary administers the oath or affirmation and then completes a jurat certificate, which states that you were sworn and signed in front of the notary on that date. The notary does not verify that the statement is actually true; the notary confirms that you took the oath and signed.
This is the key difference from an acknowledgment, which is the certificate used for many deeds and powers of attorney. An acknowledgment confirms that you signed a document willingly, involves no oath about the truth of the contents, and can be completed even if you signed the document earlier. A jurat involves an oath and requires signing in the notary’s presence. The document you bring, or the agency that will receive it, determines which certificate is required. Personal appearance, identification, and the oath
California sets specific rules for a jurat, and they shape how an affidavit appointment works. You must personally appear before the notary at the time of signing, present current and acceptable identification, take an oath or affirmation, and sign in our presence. Because the oath and the signing happen together at the appointment, you should bring the affidavit unsigned and sign it in front of us. Signatures added ahead of time do not satisfy a jurat.
Acceptable identification is usually a California driver’s license or ID card, a U.S. passport, or another qualifying government-issued photo ID, and the name on it should reasonably match the name on the affidavit. The statement should be complete before we begin, since a notary cannot notarize an incomplete document. Two separate fees apply. The per-signature notarial fee is capped by California through the Secretary of State, so the amount per notarized signature follows state rules. Separately, because we come to you, a mobile travel fee covers the visit and is quoted up front before we confirm the appointment, so you know the total ahead of time.
